1. Acceptance of Terms

By accessing or using Hubstake (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Free and Paid Tiers

Hubstake offers both free and paid subscription tiers. The free tier ("Lookup") provides access to search and receipt links. Paid tiers ("Estimator," "Firm," "Fair-Price Verification") include additional features as described on the pricing page.

For paid subscriptions, you agree to provide accurate billing information and authorize us to charge your payment method according to the plan details. Billing is handled by Stripe; your payment information is subject to Stripe's Privacy Policy.

3. License and Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or business purposes.

You agree not to:

• Scrape, automate, or bulk-download the index without written permission.
• Reverse-engineer or attempt to derive the underlying data processing or canonicalization logic.
• Redistribute the data to third parties or claim it as your own.
• Use the Service to create a competing product or service.

4. Intellectual Property

The Service, including all data aggregation, canonicalization, and presentation, is proprietary to Hubstake. Source documents (bids, contracts, receipts) are public records and belong to their respective public agencies.

Hubstake does not claim ownership of public-record data; we claim ownership of the curation, canonicalization, indexing, and analysis. You may link to items and share individual observations, provided you attribute the data to Hubstake and the original source document.

5. Disclaimers and Limitations of Liability

The Service is provided "as-is." We make no warranty, express or implied, regarding the accuracy, completeness, or fitness of the data for any particular purpose.

Use at your own risk. You acknowledge that pricing data is historical and does not guarantee future costs. Market conditions, material availability, and supply-chain factors change. Hubstake is a reference tool, not a guarantee.

To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service, including lost revenue, lost profits, or business interruption, even if we have been advised of the possibility of such damages.

6. Subscription and Billing

Paid plans renew automatically on a monthly or yearly basis (as selected). You may cancel at any time through your account settings. Refunds are not issued for partial months.

We reserve the right to change pricing for new subscriptions or renewals with 30 days' notice. Changes to your existing plan are effective on your next renewal.

7. Content and Conduct

If you submit feedback, suggestions, or data to Hubstake, you grant us a perpetual, royalty-free license to use that feedback for any purpose, including product improvement, without compensation to you.

You agree to use the Service lawfully and not to harass, threaten, or defame others. We reserve the right to terminate access for misuse.

8. Privacy

Your use of the Service is governed by our Privacy Policy. Please review it to understand our practices.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after such notification constitutes acceptance of the updated Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.

Any dispute arising under or relating to these Terms shall be resolved in the state and federal courts located in Dallas County, Texas. You agree to submit to the jurisdiction of such courts.
